B1 – Different case – Need Urgent Help

I have got B1 visa last year for 3 months and i successfully completed my business trip within that visa period, my visa got expired on 4-dec-2008 and I back to India on 3-Dec-2008.

Now I am planning to apply same B1 visa again next week. Below are my questions

1. Is there any time period to apply same category of visa again? Because my visa has expired on 4-Dec-2008 (less then one year).

2. I received the below message while I check for available appointment date

“If the consul officer determines that you misrepresented the facts, such facts will be noted on your case file and may adversely influence the outcome of your visa application. Furthermore, the consular officer will postpone your interview 90 days from the date you appeared for interview”

I have selected> Resident of India > Tamil Nadu > English > Business Visit

Have you been refused a visa twice within the last 12 months? – No
Are you applying for the same class of visa which is currently valid or has expired within the past 12 months – Yes

You can apply anytime. The 12 months question is just for the VFS appointment system which has some numbers reserved for people in that category. No other difference.
